Terms of Service
The terms governing your use of the Funxtion platform.

1. Acceptance of terms
By accessing or using the Funxtion platform, you agree to be bound by these Terms of Service. If you are entering into these terms on behalf of an organisation, you represent that you have the authority to bind that organisation. If you do not agree to these terms, do not use the platform.
2. Services description
Funxtion provides a connected fitness platform comprising FXPORTAL (content management and analytics), FXGYM (in-club screen delivery), and FXMOBILE (member app delivery via SDK, white-label, or API). Services are provided on a subscription basis as detailed in your operator agreement.
3. Operator responsibilities
Operators are responsible for ensuring appropriate use of the platform within their facilities, obtaining necessary consents from their members for data processing, maintaining the confidentiality of their account credentials, and complying with applicable laws in their jurisdiction.
4. Intellectual property
All intellectual property rights in the Funxtion platform, including software, content, trademarks, and documentation, remain the property of Funxtion International BV. Operators receive a limited, non-exclusive licence to use the platform for the duration of their subscription. Custom content created by operators remains their property.
5. Content and data
Funxtion provides a library of exercise content, workouts, and training plans. Operators may supplement this with their own branded content. Funxtion processes member data on behalf of operators as detailed in the Data Processing Agreement. Both parties will comply with applicable data protection legislation.
6. Limitation of liability
To the maximum extent permitted by law, Funxtion shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability under these terms shall not exceed the fees paid by the operator in the twelve months preceding the claim.
7. Termination
Either party may terminate the agreement in accordance with the notice period specified in the operator agreement. Upon termination, access to the platform will cease and data will be handled in accordance with our Privacy Policy and Data Processing Agreement.
8. Governing law
These terms are governed by the laws of the Netherlands. Any disputes arising from or in connection with these terms shall be submitted to the exclusive jurisdiction of the courts of Amsterdam, Netherlands.
